Pre-Arrest: The DO's AND DON'Ts
Have you or someone close to you been arrested for criminal or serious motor vehicle charges? Have you received a surprise visit or telephone call from law enforcement authorities asking questions about an investigation they are conducting, which may involve you?
What you initially say and how you respond can have a serious and profound impact not only on the final outcome of the matter, but more importantly, on your life for a long time to come. Whatever you do - here are some DO's and DON'Ts:
Do give your correct name, address and date of birth.
Do ask to immediately contact a lawyer. This is your Constitutional right if you are "in custody". "In custody" means that you are not free to leave when you want to.
Do try to remain calm despite how difficult it may be.
Don't permit anyone into your place of residence unless the police have a valid search warrant signed by a judge.
Don't answer any other questions, no matter how much you think that your cooperation with the authorities may help you. Usually, it will not!
Don't be rude, argumentative or confrontational. Resisting or interfering with law enforcement officials can only make matters worse and possibly lead to the additional charges of Interference with a Police Officer and/or Resisting Arrest

STATUTE OF LIMITATIONS
If you think that you may face criminal charges for an offense that occurred in the past, it is important to understand the statute of limitations regarding criminal charges. An arrest warrant must become "active" (i.e. signed by a judge), before the statute of limitations period expires in order for an individual to be charged.
Misdemeanor offenses: 1 year statute of limitations
Felony offenses: 5 year statute of limitations
Offenses with life imprisonment/death penalty: no statute of limitations
